Renowned human rights lawyer, Femi Falana (SAN), has strongly criticised U.S. President Donald J. Trump over his administration’s policies toward Cuba, warning against what he described as illegal sanctions and potential military aggression.
In a statement titled “Illegality of President Trump’s Sanctions on Cuba,” Falana argued that recent actions by the U.S. government violate both domestic and international law, particularly threats of regime change and possible military intervention.
He accused Trump of imposing unlawful economic sanctions through an executive order targeting countries supplying oil to Cuba, stressing that such measures lack constitutional backing.
Citing a ruling by the United States Supreme Court, Falana noted that similar tariff actions had already been declared unconstitutional, as only the legislature holds the authority to impose taxes.
“The Constitution clearly reserves taxation powers for Congress,” Falana maintained, adding that the court’s decision invalidates the legal foundation of the president’s trade policies.
Beyond legal concerns, the senior advocate highlighted the humanitarian impact of the sanctions, claiming they have severely crippled Cuba’s economy and worsened living conditions for its citizens.
He pointed to a recent nationwide blackout that left millions without electricity for over a day, linking the crisis to restrictions on oil supply caused by U.S. policies.
Falana also dismissed claims of diplomatic engagement by Washington, stating that talks have stalled because Cuba’s President, Miguel Díaz-Canel, insists on negotiations based on equality, sovereignty, and mutual respect.
Raising alarm over Trump’s remarks about potentially “taking Cuba in some form,” Falana warned that such statements amount to threats against the country’s sovereignty and could destabilize global peace.
He further cautioned that the U.S. president does not have the constitutional authority to declare war without approval from Congress, urging American institutions to uphold the rule of law.
Falana concluded by calling for restraint and strict adherence to legal frameworks in international relations, warning that unchecked executive actions could deepen global tensions.
