The United States Conference of Catholic Bishops (USCCB) has filed a major legal challenge against former U.S. President Donald J. Trump over his controversial attempt to end birthright citizenship in the United States.
In an amicus curiae (friend-of-the-court) brief submitted to the Supreme Court of the United States, the Catholic bishops, alongside the Catholic Legal Immigration Network (CLINIC), urged justices to declare the executive move unconstitutional and morally unacceptable.
Bishops Warn Of “Climate Of Fear”
Church leaders said the proposed policy has intensified anxiety among immigrant communities, describing the current political atmosphere as one marked by fear and the growing vilification of migrants.
They stressed that children born in the United States should not suffer consequences because of their parents’ immigration status.
“Children do nothing wrong by being born in the United States,” the bishops stated in their legal brief. “Stripping them of citizenship would amount to an outrageous punishment.”
Constitutional And Moral Arguments
According to the filing, birthright citizenship is firmly grounded in the U.S. Constitution, particularly the 14th Amendment, which grants citizenship to anyone born on American soil.
The bishops argued that ending the policy would:
- Violate constitutional protections
- Undermine federal law
- Deny the basic human dignity of children
They warned that such a move could leave many newborns effectively stateless.
Church Teaching Cited
The USCCB also referenced the teachings of Pope Francis and Pope John Paul II, emphasizing that excluding people from civic participation contradicts core Christian values of human dignity, compassion, and justice.

The case — Donald J. Trump v. Barbara et al. — has reached the Supreme Court on an accelerated path, highlighting its national importance and the urgency surrounding immigration policy debates in the United States.
Church leaders concluded that dismantling birthright citizenship would not only challenge constitutional law but also erode the moral foundations of American society.
