A recent Court of Appeal judgment has sparked fresh legal debate over the validity of the African Democratic Congress (ADC)’s national leadership and its implications for the party’s 2027 presidential nomination process.
Constitutional lawyer Aloy Ejimakor argued that the court’s decision, which reportedly nullified the party’s national convention, has created legal uncertainty surrounding nominations that emerged from the process, including the presidential ticket of former Vice President Atiku Abubakar.
According to Ejimakor, the judgment casts doubt on the legitimacy of candidates nominated through the invalidated convention and could influence how the Independent National Electoral Commission (INEC) recognizes future party activities.
He further stated that the ruling reinforces the authority of the ADC’s elected state executive committees, affirming that only the recognized state chapters have the constitutional power to conduct state congresses. The court also held that elected state chairmen are entitled to complete their four-year tenure.
Ejimakor maintained that the judgment may require INEC to deal primarily with the duly recognized state chapters rather than the party’s disputed national caretaker leadership in matters relating to congresses and internal party activities.
Despite the legal arguments raised, the ADC has maintained that its 2027 presidential ticket remains valid and unaffected by the Court of Appeal’s decision.
Political observers say the ruling could shape future legal and electoral developments within the party as preparations for the 2027 general elections continue.
