The Israeli military has dropped criminal charges against five soldiers accused of sexually abusing a Palestinian detainee in a case that sparked global outrage after a disturbing video of the alleged assault surfaced online.
The decision was announced by the Israel Defense Forces (IDF), bringing an end to a high-profile investigation connected to an incident said to have taken place at the Sde Teiman detention facility, where Palestinians detained during the Gaza war were reportedly being held.
According to reports, the soldiers were accused of violently assaulting the detainee, who later required hospital treatment for serious injuries. Medical examinations reportedly revealed fractured ribs, a punctured lung and severe rectal injuries that required surgical intervention.
The alleged abuse was partly captured on surveillance footage that later leaked to the Israeli media. Reports indicated that the video showed soldiers surrounding the blindfolded detainee with shields, apparently attempting to block cameras while the assault was carried out.
The leaked footage triggered strong condemnation from international human rights organisations and governments, raising serious concerns about the treatment of Palestinian detainees amid the ongoing conflict involving Israel and militant groups in Gaza.
However, military prosecutors said the case could not proceed due to what they described as “exceptional circumstances.”
According to the military’s legal authorities, investigators were unable to obtain testimony from the alleged victim, who had since been released and returned to the Gaza Strip. Prosecutors also expressed concerns that procedural issues related to the leaked video could compromise a fair trial.
Following a legal review, Israel’s top military legal authority concluded that the available evidence would not be sufficient to secure a successful prosecution in court.
The case had earlier led to the arrest of the soldiers and a military police investigation, but it quickly became a major political controversy within Israel.
Supporters of the soldiers, including far-right activists, staged protests outside military bases where the suspects were being held for questioning. Some demonstrators reportedly attempted to force their way into military facilities in protest against the investigation.
Several Israeli politicians also publicly defended the soldiers, arguing that troops operating during wartime should not be unfairly targeted.
Israeli Prime Minister Benjamin Netanyahu also voiced support for the soldiers following the decision to drop the charges, saying the country must stand firmly behind its military personnel during periods of conflict.
Human rights organisations, however, have strongly criticised the decision, warning that it may reinforce what they describe as a culture of impunity surrounding abuses against Palestinian detainees.
The Public Committee Against Torture in Israel said the move raises serious concerns about accountability within Israel’s military justice system.
Rights groups have long alleged that Palestinian detainees captured during military operations face harsh treatment inside Israeli detention facilities, including torture and other forms of abuse.
The Sde Teiman detention facility has previously faced scrutiny from international observers over similar allegations involving detainees held during the war.
International human rights monitors have repeatedly called for independent investigations into allegations of torture, sexual violence and mistreatment of Palestinians in custody.
The decision to drop the charges has now reignited global debate over accountability, detainee rights and the limits of military justice during wartime.
The controversy also adds to growing international scrutiny of Israel’s conduct in the conflict that escalated following the October 7, 2023 attacks by Hamas.
