The Federal High Court in Ikoyi, Lagos, has scheduled committal proceedings for May 11–12, 2026, against Assistant Inspector General of Police Emmanuel Ade Aina and 30 others over alleged contempt of court.
The case stems from accusations that the defendants interfered with the affairs of the Incorporated Trustees of Divine Homes Residents Association (ITDHRA), undermining court orders and prompting the arrest and prosecution of former association chairman, Uche Nwabueze.
Justice Ambrose Lewis-Allagoa directed that notices of the contempt proceedings be served at the court and the addresses of the alleged contemnors, requiring them to show cause why they should not be imprisoned for defying court directives.
The allegations include:
- Resisting execution of a valid judgment from January 5, 2024, reaffirmed on November 21, 2024.
- Conducting elections under a constitution previously nullified by the court.
- Operating a parallel executive committee that blocked Nwabueze from assuming control of the association.
- Repeatedly detaining Nwabueze despite an interim court order restraining his arrest.
Counsel for the applicant, Pius Segun Abioro, cited Section 72 of the Sheriffs and Civil Process Act, which empowers courts to imprison individuals who fail to comply with court orders, urging the court to enforce its authority and uphold judicial integrity.
The conflict traces back to the 2024 judgment nullifying the association’s April 6, 2018 constitution and barring interference in its administration. Despite the ruling, a faction allegedly continued to operate a parallel leadership, prompting further legal action.
The upcoming proceedings could result in prison sentences for the alleged contemnors if the court finds them in violation, highlighting ongoing challenges in enforcing judicial authority in Nigeria.
