The Kwara State Government has initiated criminal defamation proceedings against former Senate President and former Kwara State Governor, Bukola Saraki, over comments alleging that Governor AbdulRahman AbdulRazaq did not attain education beyond the secondary school level.
The case came before the Kwara State High Court in Ilorin, where Justice M.O. Folorunsho ruled that the court has the jurisdiction to hear the matter and dismissed all preliminary objections raised by Saraki’s legal team.
According to court documents, the state alleged that Saraki made and circulated the statement on or about April 17, 2026, through social media platforms and newspaper publications. Prosecutors argued that the statement was false, insulting, and capable of provoking public unrest, contrary to Section 399 of the Penal Code, Cap. P4, Laws of Kwara State, 2006.
Saraki’s counsel, led by Jimoh Mumeen (SAN) and represented in court by T.A. Ahmed, urged the court to dismiss the charge, arguing that it was improperly filed and that the High Court lacked jurisdiction. The defence also contended that the matter amounted to an abuse of court process.
However, the prosecution, represented by Rafiu Balogun, opposed the application, describing it as lacking merit and asking the court to allow the case to proceed.
In his ruling, Justice Folorunsho held that the objections raised by the defence were without merit and affirmed that the allegations before the court disclosed a case that could be heard. The judge also stated that Saraki’s physical presence was not required during the hearing of the preliminary application because it was interlocutory in nature.
The court further noted that, based on the charge sheet and accompanying proof of evidence, there was no indication that the prosecution was politically motivated.
Following the ruling, Justice Folorunsho adjourned the case until July 22, 2026, when Bukola Saraki is expected to appear before the court for arraignment on the criminal defamation charge.
The case is expected to draw significant public and political attention as legal proceedings continue.
